The Lessee agrees to pay the deposit sum of _________$ CDN to the Lessor on signature of this lease.
This lease is only for residential purposes and is restricted to the number of persons indicated in this lease. The premises cannot be used for large gatherings, parties or events without the Lessors agreement.
DEPOSIT POLICY :
A. 50% deposit on signing of the rental contract and the balance payable 30 days prior to the arrival date.
B. Rentals require the first months rent on signing of the contract.
A one month payment is due on arrival held as a “security deposit” which is refunded on final departure or can be applied as last months rent at the Lessor’s discretion.
- Please inform us if payment sent is from a different name other than that indicated in the contract.
PAYMENT PROCEDURES – OPTIONS – POLICY :
Payments by check must be made out only to the name of “Leighton Barrett”. Deposit and balance payments by check can be sent via mail from clients in Canada or the United States : Lessor must be advised of posting date. Payments received in USD check funds will be converted to Cdn $ and the value will be advised to the Lessee by email on depositing. Such amount will also show on the rental contract which is faxed back to the Lessee the following day from deposit date. (I have a USD checking account so there is no conversion costs other than the current exchange rate).
USA Clients option for deposit payment : Payments can be sent to my email address : LBTSD@aol.com via PAYPAL (we do not accept credit card directly but payments can be done via Paypal from clients credit cards if they so wish to do so as we are set up to accept payments this way with Paypal).
Overseas clients : Can option to pay by Paypal (Paypal fees are added to the rental cost). Wire transfer bank to bank is preferred (banking info can be supplied on request).
Canadian clients : Payment by check or Interact bank payments by email… it is quick, efficient and a safe way to make payments….Almost all Canadian banks now have this service for their clients… There is however a maximum 1 000 $ per transfer and $2000 per day. Clients paying more than $1000 for their deposit can do so in multiple transfers.
REFUND POLICY : Up to the full amount of the rental fee is refundable only providing we can re-rent the property for the same period : or portions thereof at the re rented value. The earlier notice of a cancellation allows us more time to try to achieve a new fill in rental for the same period.
MONTHLY EXTENSION OF A LEASE : The Lessee has the first right of option to extend this lease for extra partial monthly extensions at prorated daily amt (in one week periods or less) providing that 30 day notice is given and acknowledged by the Lessor having received : and that the Lessor has not advised the Lessee that another party has made a commitment to lease at the end of this lease.
SECURITY DEPOSIT / CONTENTS : Prior to taking possession of the residence, the Lessee shall give an amt of : $________Cdn (Enter security deposit amount only if requested by us and agreed to by you) made to the order of Leighton Barrett, to guarantee that upon leaving, the condition of the premises (furnishings, fixtures, etc.) will be same as upon taking possession.. The said amount will be refunded to the Lessee after inspection of the premises by the Lessor or his representative and the final payment of bills (telephone long distance and any pay for view TV billing, etc.). Upon possession the Lessee should notify the Lessor to any damages or problems that are pre-existing to the premises so that they are identified as pre occupation issues.
SERVICES PAID FOR BY LESSOR :
1.
Heating and Air Conditioning and Electricity.
2.
Bedding linen and towels. Premises come with washer and dryer.
3.
Satellite TV, High speed wireless Internet, (limited service) and local telephone service with answering 
machine.
SERVICES AND COSTS RESPONSIBLE BY THE LESSEE :
1.
Long distance telephone charges & directory assistance.
2.
Pay per view TV billing if ordered.
3.
Parking (if other than street parking in unrestricted portions of the street which are free).
4.
Cleaning to pay for either weekly or biweekly cleaning services. Cleaning is charged at $15 per hour and is 


payable to the cleaning lady in cash the same day.
5.
Exit cleaning cost of 60$ or 90$ as applicable to the # of tenants..
6.
Download & uploading charges in excess of normal use of Internet service (we request you do not use the Internet for activities like : on line gaming, video downloading, etc.). It can result in charges you will have to pay. Maximum over usage charge is 50$.
7.
Damaged or excessively soiled linens or carpets (replacement or cleaning costs); excessive exit cleaning.
ADDITIONAL PROVISIONS :
1.
Major Repair Provision : All major repairs to the rented premises will be at the expense of the Lessor and the Lessee will not be entitled to any rent reduction, damages or any other compensation due to these repairs, provided these are done within 30 days. We are talking about non-scheduled repairs that may occur for unforeseen reasons and require immediate attention : the Lessor prior to the signing of this lease must acknowledge any pre-planned repairs to the Lessee.
Tenants are advised to have “Tenant Insurance” which covers their personal possessions for replacement costs as well as can provide “relocation expenses” in the event of a major problem which would necessitate a tenants needing to vacate the premises.
2.
Maintenance of the Premises : Lessee shall maintain the interior of the premises clean, orderly and tidy, ensuring that the premises are free of insects, rodents, vermin or other pests. The Lessee shall keep all perishable items properly refrigerated. The Lessee shall be responsible for any damage resulting from spikes, hooks, screws or nails put into walls, woodwork, ceiling or floor of the premises by the Lessee. Following termination of the lease, the premises will be inspected and any damages assessed. The Lessee will be advised should damages be noted. Payment for damages as well as payment for the final cleaning of the premises will be the Lessees’ responsibility. Such damages may exceed any retained Damage deposit amount retained by the Lessor. Lessee is still responsible for all damages and costs of repair exceeding a damage deposit amount.
3.
Alterations Modifications and Repairs : All alterations, modifications and repairs within the premises during the term of the lease are prohibited without the consent of the Lessor. At the expiration or other termination of the term of the lease, the Lessee shall surrender the premises in its original state in which it was received. The Lessor shall not be held responsible or liable for any accident, loss, or damage or injury or inconvenience arising from the rental of the premises, except insofar as that the occurrence is caused by the direct negligence of the Lessor or his acting employees. (Lessee is accepting the present configurations of design of staircases and railing both interior and exterior). Lessee is advised to obtain “Apartment insurance”, which may or may not be covered by a Lessees existing home ownership policy. All claims are acknowledged to be solely between the Lessee and the Lessor and will be governed by the laws of the Province of Quebec.
4.
Blocked Sinks and Toilets : All toilets and sinks are checked before every rental and are clean and clear of obstructions. The Lessee is responsible for all blocked sinks and toilets caused by the Lessee and or his guests. These must be unblocked at the Lessee’s expense. Lessee is also responsible for any broken windows or other damages to the premises.
5.
Garbage : At no time whatsoever, for whatever reason, should garbage be left unattended in the premises or on the property. The Lessee shall deposit trash and garbage in tightly closed standard size green garbage bags only, and deposited on the sidewalk on the two designated collection days for the rental premises.
6.
Noise : Excessive noise will not be tolerated in or around of the property. The Lessee shall see to it that the television, radio, stereo, or other sound equipment, cannot be heard in the common areas and in other adjacent neighbors / tenants dwellings. This applies at all times of the day and night.
7.
Failure to Take Possession : Should the Lessee fail to take possession of the premises or depart from the premises prior to the expiration of the present agreement or cancel a lease or portion of a lease, the Lessor shall have the right to take immediate possession thereof and re-rent same for such rent and upon such terms as the Lessor shall determine. The Lessee undertakes to pay all deficiencies resulting from such subletting. Failure to take possession will result in no repayment deposit or first months rent.
7(A) A set of 2 keys will be supplied on occupancy. Some door locks may have keyless digital entry locks and the Lessee will be allowed to assign a 4 or 6 digit entry code to the loft itself for security. Under no circumstance can the Lessee change the master entry code (this master code is only known to the Lessor and his immediate employees and the cleaning staff).
8.
Cancellation of lease : The Lessor can under unforeseen or uncontrollable circumstances, cancel the lease. The Lessor will give all possible advance notice to the Lessee, and will assist to help find alternative lodgings of a similar style, size, and value, but the Lessor does not preclude to guarantee such as assured . In such a case the Lessee would also be allowed to secure their own accommodations. In any case, any deposit received would be either applied to alternative lodgings or refunded in full to the Lessee.
8(A).
Failure to abide by the covenants agreed to in this Lease by the Lessee, shall give full rights to the Lessor to cancel without notice the Lease and demand immediate eviction.
9.
Provisions to Visit for Rental Viewing Purposes : Lessee agrees to allow scheduled visits for the purpose of rental viewing with 24 hours notice by the Lessor : to be scheduled at times for the mutual convenience to both parties.
10.
Security Alarm Systems : For all Lofts where there is a security alarm system installed, the Lessee is responsible to ensure that the system is activated when unoccupied. Failure to utilize the alarm system will make the Lessee 100% responsible for any occurrence of a break-in or theft or damage to the property and the subsequent costs involved. The property insurance does not cover events of burglary when a security system is not in activation.
11.
Proof of identity: On occupancy, the renting party (principal signing person) must supply a photocopy of identification (passport or drivers license).
12.
Internet facilities: The Lessor is providing a high speed Internet connection. This Wireless Network Connection is available in all our rental lofts. The Network key or encryption code to allow access, will be provided, however the Lessee has to assume their own computer set up (i.e. having either their own wireless card or an integrated wireless set up on their computer). Or : for a Dial up Connection, we recommend the Lessee check if his Internet Service Provider has service in Montréal. As with all Internet Providers, they can experience interruptions and we do not guarantee their service. We have verified all wireless services as 100% operational. Lessee is responsible for their own computer set up and configurations necessary for the wireless setup.
13.
No smoking: We advertize the property as smoke free. Clients wanting to smoke can only do so outside the property. Clients may use balconies and roof terraces but must dispose of cigarette butts properly. Failure to abide by this policy may require extensive cleaning services at the client expenses.
14.
Vacating the premises : Clients are to inform the Lessor of their day and time of departure. Should the Lessor not be available to do an inspection at the time of departure, the client is to leave both sets of keys inside and ensure the front door is security locked with the electronic door lock system. There is no provision for any reimbursement of rental costs for early departure on the Lessees behalf, unless re rented by the Lessor for the same time period.
